Petition Filed in Peshawar High Court Against Emergency and Governor’s Rule in Khyber Pakhtunkhwa; Barrister Gohar Requests Swift Judicial Review

ISLAMABAD: Pakistan Tehreek-e-Insaf (PTI) has taken the federal government to the Peshawar High Court on a constitutional petition, challenging the government’s administrative takeover in Khyber Pakhtunkhwa, for the imposition of emergency and Governor’s Rule.

The petition, submitted by PTI Chairman Barrister Gohar Ali Khan, also seeks immediate hearing before the court and null and voidness of the notification of Governor’s Rule.

Following are the key highlights of the Peshawar High Court Petition:
Legal Challenge to Administrative Takeover: Petitioner states that the emergency and Governor’s Rule is a way to bypass the provincial powers, and the court should do this and return to the constitutional structure of KP.

Barrister Gohar reiterated his assertion and said that the party would remain peaceful, constitutional and legal in its struggle in the court, which ensures that the party remains committed to democratic values and an independent judiciary.

The legal move follows the three-day delay in the issuance of the official summary of the proclamation of emergency and Governor’s Rule in the province by President Asif Zardari, who had received advice from the Prime Minister Shehbaz Sharif to do so.
